General note
Bill C-3 An Act to amend the Immigration and Refugee Protection Act (certificate and special advocate) and to make a consequential amendment to another Act was a government bill introduced in the House of Commons on October 22, 2007. Bill C-3 allowed for the continued use of security certificates and the appointment of special advocates to challenge evidence on behalf of detainees. Bill C-3 received Royal Assent on February 14, 2008.
General note
Under the authority of a security certificate, the Government of Canada can detain and deport foreign nationals and permanent residents in Canada who are suspected of violating human rights, having membership within organized crime, or are perceived to be a threat to national security. The Government of Canada does not disclose information about any trial involving a security certificate as such information may endanger the safety of a person or threaten national security. This lack of disclosure has led to significant criticism of security certificate process and secret trials.
